Trading post terms of use at Saxquest

The following describes the terms by which Saxquest offers you access to our trading services. Failure to abide by these terms may result in suspension or termination of your Saxquest membership, at the sole discretion of Saxquest, Inc.

The Saxquest free trading post is only a venue. The Saxquest.com website acts as the venue for sellers to list saxophones and mouthpieces (or, as appropriate, solicit offers to buy) and to view buyer's want ads and for buyers to view the listed items and to post want ads. We are not in any way involved in the actual transaction between buyers and sellers unless we are specifically asked to moderate a transaction. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, or the ability or willingness of buyers and sellers to follow through with the transactions.

Because we are not involved in the actual transaction between buyers and sellers, in the event of any dispute, you release Saxquest (and our officers, directors, agents, subsidiaries and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such a dispute. Saxquest or our suppliers shall not be liable under any circumstance for lost profits or any special, incidental or consequential damages arising out of or in connection with the Saxquest.com website, our services or this agreement (however arising, including negligence). You agree to indemnify and hold Saxquest and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. You shall comply with all applicable laws, statutes, ordinances and regulations regarding your use of our trading service and your listing, purchase, solicitation of offers to purchase, and sale of items. Users are strictly forbidden to post any listing that has associated with it any type of fraudulent activity.
